Point plans reception for president

POINT PLEASANT — Marshall University has plans next
month to stage a reception
in Point Pleasant to welcome
the school’s interim president,
Gary G. White.
The reception for White is
being planned for 5-6 p.m. Feb.
3 at Marshall’s Mid-Ohio Valley Center, located at 1 John
Marshall Way, in Point Pleasant. The reception is open to
all Marshall students, faculty,
alumni and the community.
A second reception is also
being planned Feb. 19 in South
Charleston.
White was appointed Dec.
29 by the Marshall University Board of Governors to
replace Dr. Stephen J. Kopp,

who reportedly died of a heart
attack about a week before
Christmas. Kopp had been
Marshall University’s president
for the last 10 years.
White officially assumed
interim president duties on
Jan. 1.
“I’m gratified and humbled
the board of governors has
asked me to serve in this
important interim role,” White
said in a press release at the
time of his appointment. “I
look forward to working with
members of the board, the faculty and the staff to keep our
university moving ahead and
focused on students.”
A businessman and coal mining executive, White graduated
from Marshall in 1997 with
a Regents Bachelor of Arts
degree. He is a former member

and past chairman of
the university’s Board
of Governors, former
member and vice president of the West Virginia Board of Education,
and former member of
the University of Pikev- White
ille Board of Trustees.
He has been executive vice
president of Blackhawk Mining LLC since October. He
was president and chief executive officer of International
Industries Inc. for a large part
of his career — from 1992
to 2007. He also previously
served as president and chief
operating officer of International Resource Partners LP,
a branch of James River Coal
Co., president and chief executive officer of the West Virginia
Coal Association, manager of

underground mining at
Amherst Coal Co. and
corporate training coordinator at Island Creek
Coal Co.
White is on the
boards of directors of
United Bankshares Inc.,
ARC Logistics Partners
LP, Cabell Huntington Hospital, the Marshall University
Foundation, the West Virginia
Coal Association and the Larry
Joe Harless Community Center
Foundation Inc. He also serves
on the board of advisors of
West Virginia Media Holdings

He received the 2006
Distinguished Achievement
Award from the West Virginia
Education Alliance, the 2004
Distinguished Service to the
Community Award from the

Marshall University Alumni
Association, the City of Hope
“Spirit of Life Award” in 2003
and, also in 2003, was inducted
into the Business Hall of Fame
at Marshall. In 2006 and again
in 2008, he was named one
of the “Fifty Most Influential
Individuals in West Virginia”
by West Virginia Executive
magazine.
A reception for White was
conducted earlier this month at
the Huntington campus.
White will serve as interim
president until a permanent
president is hired, which is
expected to take another five
to eight months. He will make
$400,000 and is reportedly not
a candidate for the permanent
position.

Ohio AG sues Middleport’s tool against winter weather
over health
care law tax
COLUMBUS (AP) — Applying a tax aimed at helping keep premiums affordable under the federal health
care law to state and local governments is unconstitutional, Ohio Attorney General Mike DeWine claimed in
a lawsuit filed Monday.
The complaint argues there’s no precedent for the collection of $6.25 million for 2014 from government entities and nothing in the health overhaul law that allows
such a tax.
The lawsuit also challenges a provision in the law
that calls for a chunk of the money being collected to
go directly into the Treasury’s general fund and not the
health care program.
At issue is a provision in the law permitting tax assessments against health insurance companies and certain
employers who offer self-insured group health plans.
The government lacks constitutional authority to
impose “such broad-based, revenue-generating taxes”
against states and local governments, the lawsuit said. It
seeks a return of the money and stopping similar assessments for 2015 and 2016.
The parties include the state, Warren County, the University of Akron, Bowling Green State University, Shawnee State University and Youngstown State University.
The lawsuit is a follow-up to a Jan. 8 letter sent to U.S.
Health and Human Services Secretary Sylvia Burwell
protesting the tax, DeWine, a Republican, said in a statement. His office said the lawsuit is believed to be the
first challenge of the tax nationally.
The Department of Health and Human Services
declined to comment on the lawsuit.
The agency says the law has helped keep premiums
affordable, with eight of 10 people enrolled in the federally run insurance marketplace as of December getting
coverage for $100 or less per month after tax credits in
2015.
The lawsuit challenges the following assessments:
$5.4 million from the state, $325,584 from the University of Akron, $275,247 from Bowling Green State University, $108,517 from Youngstown State, $94,710 from
Warren County and $56,007 from Shawnee State.

Marshall to host Winter Jazz Festival
HUNTINGTON, W.Va.
(AP) — Marshall University will host one of the
longest running collegiate
jazz festivals in the nation
when the School of Music
and Theatre presents the
46th Annual Winter Jazz
Festival Jan. 29-31.
Dr. Martin Saunders,
director of jazz studies at
Marshall University, said
the festival provides a
venue for middle school,
high school and collegiate
musicians to meet, perform for and learn from
the best of jazz professionals.
“Students learn through
critique and feedback of
their performances, participation in clinics and
workshops, and through
observation of stellar
evening performances,”
Saunders said.
The festival kicks off at

7 p.m. Thursday, Jan. 29,
at the Joan C. Edwards
Playhouse on Marshall’s
Huntington campus
with a concert featuring
Bridgeport High School’s
Honor Band, Glenville
State College’s Jazz
Combo, Marshall’s Jazz
Combo I and the university’s Faculty Jazz Combo.

Ensemble I with special

a 1941 graduate of Pomeroy High School. She was

50 years of Reynoldsburg
Church of the Nazarene.

death by her husband,

CHESTER TOWNSHIP — Howard E. Frank
passed away Monday,
Jan. 26, 2015, after a long
illness. He was 85.
Born in Chester Township on April 8, 1929,
Howard was a lifelong

and a fixture in the Meigs
County Courthouse for
more than 50 years. He
started his career of public service as the youngest
mayor of Racine, and held
several elected positions
including auditor, sheriff
and treasurer, where he
retired in 2009. He also
served his country in the
United States Army.
He was preceded in
death by his parents, Herman and Letitia Frank;
two brothers, Clarence
and Denver; a sister,
Grace Price; and his son,
Ray (Mary Jo) Frank.
He is survived by his

daughters Anna Norman, of Racine, and Lois
Spencer, of Jackson; a
grandson, Corey (Lindsey), of West Mansfield;
five granddaughters,

than $674,000 in December.
BWC designed the
Safety Intervention
Grant Program to assist
Ohio employers in
reducing illnesses and
injuries and to create a
partnership with them to
establish best practices
for accident and injury
prevention.

for grants from employers across the state,”

COLUMBUS, Ohio (AP) — Ohio ranked fifth
among states for its number of overturned convictions last year, according to a national report.
The Columbus Dispatch reports Ohio had six
exonerations in 2014, following Michigan, Illinois,
New York and Texas, which led the country with 39
exonerations.
A record 125 exonerations were reported nationwide last year, according to the National Registry
of Exonerations report compiled by the University
of Michigan Law School. The previous high was 91
exonerations in 2013. The increase was due in part
to cases in Texas in which individuals had their drug
convictions dismissed after lab tests determined they
never had illegal substances, the report showed.
The list of Ohio exonerations included Kwame
Ajamu, Wiley Bridgeman and Ricky Jackson, three
men convicted and sentenced to death in the 1975
slaying of a Cleveland businessman. Charges against
them were dropped last year after the key witness
in the case— a then-13-year-old boy— recanted in
2013.
Other Ohio men exonerated in 2014 included Joel
Covender, convicted of child sex abuse in Lorain;
Dewey Jones, convicted of murder in Akron; and
Anthony Lemons, convicted of murder in Cleveland.
The six exonerated men served a combined 173
years in prison.
More than half of 2014 exonerations were initiated
or supported by law enforcement or prosecutors,
said Samuel Gross, a University of Michigan law professor who edits the registry.

Although the Islamic State has dramatically
increased its territory in Syria, President Obama
mentioned it just twice during his State of the
Union address — twice in a single paragraph.
That strange brevity is characteristic of the
Obama administration’s approach to foreign
policy leadership at home: light on details, weak
on messaging and over-reliant on a “just trust us”
attitude.
We could be losing in our mission “to degrade
and ultimately destroy” what Obama calls ISIL.
We could be winning in some ways and losing
in others. But we wouldn’t know it. As a result,
regardless of what secret advances might be under
way, the administration is losing its way, and losing the confidence of the American people.
It is galling how phony the president is willing
to be. “In Iraq and Syria,” the president claimed
in his address, “American leadership — including
our military power — is stopping ISIL’s advance.”
That’s flatly contradicted by events on the
ground in Syria.
“Instead of getting dragged into another ground
war in the Middle East,” he continued, “we are
leading a broad coalition, including Arab nations.”
But the international press reported that U.S.
ground troops at the Ein al-Asad air base in Iraq
were attacked by Islamic State forces in December. Just the other day, the Lebanon Daily Star
reported that Canadian special forces engaged the
enemy in combat.
There is a ground war. The theater of war
extends well beyond Iraq. And we are in it, boots
on the ground, shooting and being shot at.
All that is left of Obama’s glib depiction of our
involvement is a scrap of rhetoric — the image of
being “dragged into” conflict.
But who inserted us into the war, if not Obama
himself?
That’s why he took precious time from his State
of the Union to urge Congress to pass a resolution authorizing a military campaign against the
Islamic State — the one we have already launched,
and from which we cannot extricate ourselves.
This is a war being fought in reverse, with the
American people coming up last in order of priority. The Islamic State poses a serious threat to
American interests. The administration ought to
beg for forgiveness for letting it become such a
problem. Instead, it seeks a rubber stamp.
And because Congress will not be so foolish
as to strip this war of funding, it will proceed.
The least President Obama could do is treat it
like the proper war that it is. At home, above all,
that means speaking to the American people like
adults.

Club will present “Blizzard of Bands,” a concert
showcasing local bands, on Friday to help raise
funds for its upcoming annual spring musical production.
K92 FM is sponsoring the event. The lineup of
acts includes Marauder, Ben Davis Jr. and the Dirt
Poor Troubadours, Elephant Head, Windfall and
Guilt Trip.
The event will take place at 7 p.m. in the Meigs
High School gymnasium. General admission is $5
and concessions will be served.
The funds raised at the show will enable the
drama club to purchase audio equipment and special effects for its upcoming production of “Shrek
the Musical” in late March.

The Defenders

The Gallia County Children Services Board and the Meigs
County Department of Job and Family Services, Children
Services Division are seeking an individual or agency to
provide recruitment activities, for a shared services project, to
recruit new adoptive/foster homes in the two counties. This
is a grant funded position ending December 31, 2015. The
primary function of this position is to recruit, arrange training
and provide follow-up activities to newly licensed adoptive/
foster homes in both Gallia and Meigs County. Interested
