The suspense these past weeks has been, to say the least,
bea rable. Haynsworth has been widely di~ussed if! the
press. obviously inspired. as the likely chotce. ~nd tf by
any chanc" more was needed, there was the laymg on of
hands, a week. before the announcement from the western
White House by chief congressional pachyderm, Sen .
Everett Dirksen, whose record in calling th~ sho~ on m~j.or
appointments has been rather good so far m thts admmts·
tration.
·
Now the great game be~ins-anal{sis . of Haynsworth's
record on the bench and hts persona philosophy, .speculation of the effect on the court's balance and decistons and
the politlcal maneuvering over his confirmation.
Pros and cons are, of course , relative. Wha~ wiU count
in the nominee's favor in some quarters-his reported
strict constructionist views on the admissibility of C?nfessions. or his liberal decisions on habeas corpus-will be
black marks against him in others. To be expected are the
charges that the nomination of Hayns~orth, although a
Democrat , iS another example of the President repaying an
election debt to the South.
But it should be clear by this time that Richard Nixon is
nothing if not a shrewd politician, and therefore very much
aware that weak appointments to a Supreme Court under
intense public scrutiny, thanks to the Warren era, could
have unfortunate consequences for himself in 1972. What
profiteth it a president to gain the South and lose the rest
of the country? It can be assumed that the nomination has
much more to recommend it than the regional aspect.
although there is something to be said about that, also.
While U is true that the Supreme Court is not based on
political geography (there is no constitutional bar to a
president appointing an entire court from Delaware, lr he
so chose and could get away with it), the South-which,
alter all, must live wth the court's ruling• along with the
rest M. the country and has, in fact, borne the brunt of so
many recent landmark decisions-has been underrepre· .
sented in recent decades.
Hugo Black of Alabama, the senior justice, is the only
southerner at present on a court heavily weighted toward
the Northeast (four justices from New Jersey, New York
and New England). The recently departed Fortas was, to
be sure, a product of Tennessee. But he had been so long
a member in excellent standing of the eastern liberal establishment that bis origins bad little meaning, least of aU to
the South . Of the 23 court appointments from Black's in
1937 through Chief Justice Warren Burger this year, only
four have been from the South, counting Fortas.
The analysis and maneuvering are inevitable. The specu·
lation is more-futile. Although the Haynsworth nomination would seem to reduce the hard-core liberals to threeDouglas , Brennan and Marshall-there is enough of a mix
in the Haynsworth record, as there is in Burger's, to make
prediction risky.
The record of the Burger court will be written in its decisions , and not before.

failure are being treated each year with artificial kidneys.
Artificial kidneys-or bemodialyzers-substitute for the
natural organs by f i 1 t e r i n g poisonous wastes from a
patient's bloodstream as it is passed through the device.
Cost of the treatment can range from $5,000 to as bigb as
$25,000 a year. Present dialyzers are so large and complicated !Iiat most .Patients must regularly go to hospitals
where trained medical personnel operate the equipment.
Because of the prohibitive cost as weU as lirolted availability of the machines, an estimated 50,000 other Americans
with . damaged kidneys are unable to get treatment that
could prolong their lives.
Work now being conducted at the Atomic Energy Commission's Argonne National Laboratory is aimed at helping
them.
In a joint project between the AEC and the National
.Institutes of Health, the laboratory is working to develop
·a small, inexpensive artificial kidney that a patient might
use at horne. Several prototype models already have been
built.
One measures only eight inches high, 2% inches wide
and 2¥.!: inches thick. An even smaller model is now being
tested .
Every so often one of these 50,000 cases makes tbe news.
In Florida recenUy. a young girl with kidney failure was
turned down for artificial kidney treatment because she
couldn't pay for it.
The successful outcome of the Argonne research may
make such distressing stories a thing of the past.

President Nixon's performance in his first six months
supplies fresh proof that it is very difficult to gauge how
any chief executive will behave politically once he is
elected.
Hope was wrongly invested in the late Gen. Dwight
Eisenhower, who proved to have no taste at all for presidential politico.
John F . Kennedy died. too soon for anyone to tell whether
he could translate his consummate campaign skills into the
maintenance and rebuilding of his faction-ridden party.
Lyndon Johnson's ta1ent for Senate maneuvering was
mistakenly read as broad political skiD. In fact, he had very
little of it, anti by the end of his term had long since
stopped trying' to develop it.
Richard Nixon attained victory last November with the
reputation of an unequalled "political animal, " and the
advantage of eight vice presidential years in which be per.
formed some of the political chores Eisenhower ignored.
Yet, from tbe moment of his eledlon, be ceneentrated
fiercely oo lrylo( to prove lila! he was more tbaa just a
poUtlclao-wltb the result thai his flnt mooths bave lOmelimes bordered oa dlsaoter at tbe political party level.
It is argued that a pre.(lident with a war on his handsor even with just tod.ay's compJex mix of other· foreign
and domestic matters-is simply too busy for politics in the
ordinary sense.
The claim is made for Nixon that if he is a " good president," if be settles the war and handles the othq Issues
well, that is the best politics he can possibly play and bis
party and he himself will thereby benefit hugely at the
polls in 1970 and 1972.
This could well prove to be true if the country's mood Is
deeply affected by what the President does between now
amfthen.
On the other hand, something might easily be lost in
translation at the polls next year if there are too many
failures in ordinary politics.

Parties holding presidential power tend generally to lose
some ground in the off-year elections. Voting history shows
only a few cases where this tendency has been reversed or
slowed.
Nixon's pulling power even when he was on the ballot
was slight-with a pickup of five seats in the Senate and

There may be, as some aides contend, a rare transterabJlity to others next year of a good performance as 'presi·
dent-assuming the performance is good .
