Utah residents piled sandbags to hold back floods on a Memorial Day

Across much or the nation, memorial ceremonies and other festivities

Valley, and chilly temperatures in the upper Midwest.
More than 350 people died on the nation's highways during the three-day
weekend which marks the start of the summer vacation season.
· . In San Diego on Monday, u,s. Rep, Duncan Hunter praised Albert
Sthaufelberger III, the. 33-year-old lJ .s. adviser murdered last week in El

and liberty as a person killed In combat In any of the last several wars
we've had."
At Arllngto~ National Cemetery, thousands gathered for the traditional
wreath-laying ceremonies a t the Tomb of the Unknown Soldier, and a new
tomb was dedicated to the 58,0CK! men who died In the Vietnam War. But
that crypt lies empty, because there are no unidentified casualties from the

WASHINGTON - Last week's
decision from the Supreme Court In
the ma tte r of Bob Jones University
was a bad decision In every way . It
viola tes an elementary rule of

upon the First Amendment right to

These are the facts: Bob Jones

In addition to being deceptlve, mlsleadlng and uninformative, those

During the past two decades - the period In which television has

manded by the Bible. The First
Amendment guarantees to each of
us a tight to the free exercise of
religion. Only once before, to my
knowledge, has our government
Imposed upon any sect a requirement that It abandon a religious
conviction In order to obtain rights
accorded to others. This was wllen
Utah was compelled to .renounce
polygamy In order to achieve
statehood.
In last week's decision, the court
brushed aside the "free exercise"
clause. The government's fundamentallnteest In eradicating racial
discrimination, said Chief Justice
Burger, "substantlally outweighs
wha~r. ,liUrden denial bl tax
benefits places on petitioners'
exercise of their religious beliefs."
Justice Lewis Powell wrote a
concurring opinion. He was plalnly
uneasy at letting the IRS alone
decide which ot the 100,(XX) organizations that qualified last year
under 501(c) (3) we!'!! providing
"public benefits" In harmony with
the "public Interest" or were
"beneficial and stabilizing tnnuences In community life." Justice
WUllam R.ehnqulst, dissenting, held
flatly that It Is the obligation of
Congress, and not of the courts or
the IRS. to write the tax laws. On
that point he was clearly right.
Educational and religious Institutions depend heavily UPQn the tax
exemptlo·ns that historically have
· been 'a ccorded tllem. ·
·
We have a "public policy" In
support of nuclear arms. The
Catholic bishops are preaching a
moral doctrine contrary to that
policy. We have a "public policy"

penalty to boot.
So far It sounds Innocent enough .
But then Baldrige's memo listed
the "basic facts on the licensing
Issue (which! are not In dispute."
There were nine of these "basic
facts," and the last three are
humdingers:
- "The Harbin Polytechnlcal
Institute ... Is subordinate to 7th
Machine Building Industry, which
presently cori! rl butes to the development and manufacture of stra tegic missiles."
- Harbin Polytech "Is also
located near the Military EngineerIng Institute, which Is heavily
engaged In military research."
The clincher "Intelligence sources expect the hybrid computer to
be used for missile development."
But the commerce secretary stu!

thinks It would be a dandy Idea to
sell the Chinese the computer.
Keyworth, In another secret
memo, pooh-poohed the value of the
Hyshare 700 In Peking's nuclear
missile program. It would have
"little Impact on their m!Utary
capability," he wrote. "Facilitating
their missile trajectory calculations hardly compromises our own
strategic Interests . Their ballistics
missiles represent a 'force de
frappe' to deter the Soviet Union,
albeit to a marginal ~ee."
This comforting Idea - that
Chinese missiles are a threat only to
the Soviet Union -Is belled by facts
I reported as long as three years
ago. China had developed an
Intercontinental ballistic mlssUe
with a 7,!00-mlle range- enough to
clobber much of the U.S. mainland
- and had tested it.

But this Is not what the statute
says, and untU last week's opinion
we had understood that s!gnltlcant
changes In statutory taw could be
made only by the Congress and mt
by the executive agencies. The'
statute clearly Is In the disjunctive.
It does not require that an

Let It be conceded, arguendo,

My le tte r concerns the new
count y stickers In which I am told
arc req ulred by Ia w to be placed on
our license plates. I hope that by
w1itlng this lett er. someone else will
write In with the answers to a few of
my questions.
First of all, what are the stic ke rs
· good for anyway 1 Are they for
people who ca n't re me mber which
county they live In '' !'>re they made
to let pollee officers of other
counti es know that you're fro m out
of town and not the ir boss . or the
counc il or the m ayor?
Are they to protect you from
pollee harassme nt whe n In your
home county? Or did the govern. ment buy a sticker fa ctory with the
Idea of making someone rich , by
requiring that everyone have one?
What are they good for? I don't
know. but he re's a point to bring up,
le t's say that you go to a ball game
In which Me igs High vs. Wa ha ma,
. and some trouble breaks out during
. the game . Now, somebody decides
· to get smart and do some da m age
the other team's cars .
All they have to do IS check the
plates on the cars , Wahama cars all
have - West Virginia pla tes a nd
. Meigs cars all have Ohio plates.

For 43 years Bob Jones Unlverslty routinely was certified as a -religious and educational Institution entitled to tax exemption under
Section 501(c l 131 of the Internal
Revenue Code. The section applies
to any Institution organized and
perated exclusively for ' 'religious,
charitable, scientific, testing for
public safety, literary, OR educational purposes."
In 197!1, without the sllghest
authority from Congress, the IRS
announced that henceforth no
racially segregated Institution
could qualify for the exemption.
This was the reasoning: No Institution may be deemed charitable If It
violates the public policies of the
United States; racial dlscrlmlnation violates a public policy;
therefore, any segregated lnstltu-

using a metaphor. what Is It that In
fact protects the Individual Amerlc an' s lif e fr o m arbitrary
extinction?
Even those who sympathize with
the Supreme Court's findings In
Roe vs. Wade. wherein the right to
abort was discovered, raise their
eyebrows at such terms as "useful
life." If an American forfeits his
right to llle when It Is demonstrable
that he Is nol living a "useful'' life,
any number of social temptations
come to 'mind. The president
elected to point, In his article, to the
recent case In Indiana where a
doctor deliberately starved a baby
suffertng from Down 's syndrome,
presumably In preference to letting
the child grow up notwithstanding
his disa bilities. The case of the

"Baby Doe," as judicial records
designate her, brought home to
manythelmpllcatlonsofeasygolng
standards on the question of the
protection of (God-given?) human
life.
The Supreme Court's decision In
the matter of Bob Jones ought not to
be viewed simply as a question:
"Did the court strike down things
we do not approve of?" The more
profound question Is: Is the Supreme Court now In the business of
prescribing to religion what It Is
about that religion that Is consistent
with public pollcy, ln the absence of
which consistency, normallmmunltles cease to protect It? That Is the
question . And the citation by
president of a right as God-given
reminds us how fragile these days
God-given rights have become.

INDIANAPOLIS (API - Tom
' Sneva waited 10 frustrating years

He's not complaining now.
The IndlanapoUs Motor Speedway Increased the total purse by
more than $340,<XXJ from last year.
· sweetening ltspayoffto$2,~i.1 .450the b)ggest prize {lackage In
auto-racing history.
And Sneva. a fanner schoolteacher who will be 35 on Wednes·

tor himself and the rest of the
·Bignotti-Cotter Racing Team .
"It'.squlte a relief," the spectacled
driver said, feigning seriousness as
he accepted the largest paycheck of
his · career at the annual Victory
Dinner Monday night. "After I
heard last place paid $50,<XXJ and
32nd place was $45,000, I wasn' t sure
when It wasalloverthat I'd wouldn 't
owe the Speedway money.''
Each driver, In the reverse order
of finish, was called to the podium to
accept his award. The reason Chet
FUUp, who finished 33rd, earned
more than 32nd-pla~e George
Snider was thatherecelvedanextra
$5,<XXJ In accessory prizes.
By the time Sneva came forward ,
however, It was obvious his award
was going to be considerably more
than even he expected; , nearly
$100,<XXJ more than Gordon Johncock received for winning the race
last year.- .. · · . . , · ·
· "lt'salotofrruiney," Sneva said.
Actually, hewon'tgetalloflt. The
driver usually gets a fixed percentage, agreed to before the race.
Sneva wouldn't say exactly how
much he'll take home, but he
admitted lie's "going to end up with
tiO-plus percent. We'll find something to do wlth'lt."
That stU! would be more than
$154,<XXJ- l'K!.t '!1. ba~ haul for ~
·hours of driving. His teammate,
fifth-place finisher Kevin Cogan,
added another $73,756 to the Blgnottl
team etfort.

Sneva stayed up front the entire
race, never falling below sixth
place. He took a seemingly comfortable lead In the late going but lost It
to AI Unser after a lengthy pit stop,
and he had to play catch-up for the
next 20 laps or so. It was made more
difficult by the lntentlonallmposl·
!ion of AI Unser Jr .• the three- time
winner's son , between the two
leaders .
.. o.Twlce, Sneva almost caught AI
Jr ., going high on the track the first
time and down low toward the apron
the next. Both times, the21-year-old
rookie chopped hJm off at the first
turn, preserving the leadforhlsdad .
Finally, when all three cars,
separated by less than one sec6nd.
. overtook some slower traffic . Sneva
maneuvered around AI Jr. and then .
swept by Big AI for a lead he never
lost.
Sneva gain\!(! about one seccnd a
lap after that, finishing some 11
seccn~ ahead of the elder Unser.
Rick Mears wound up third,
,!Glllowed by Geoff Brabham, Cogan.
J,towdy Holmes, Pancho Carter,
Chip Ganassl and Scott Brayton. AI
Jr., who was penalized two laps for
Ulegally passing both his father and
Sneva during a yellow caution
period, wound up lOth.
Sneva, who made his first
appearance at Indianapolis In 1974,
matched a record held by four other
drivers by finishing second for the
thJrd tlnie In 1980. The others were
BUI Holland, Ha!Ty Hartz, Jim
· Rathmann and Wilbur Shaw: - '
Unser Is now the sixth member of
the three-time runner-up club.
The Blgnottl winnings were part
of a record total purse of $2,411,450
for the 67th running of the 500, about
$343,000 more than the former
record of $2,067,475 set last year
when Johncock won for the seccnd
time.
. An Increase ot about $175,<XXJ In
accessory prizes accounted for the
bulk of the record purse. The
Speedway's share was raised about
$167,(XX).
